PUBLIC AGREEMENT (OFFER)

For the provision of a flight with an instructor (Paragliding) service in Oludeniz, Turkey 🇹🇷

This agreement is an official and public offer of the Contractor to conclude an agreement for the provision of a flight with an instructor (paragliding service) provided by Fly Oludeniz on the website https://fly-oludeniz.com.

This agreement is public, that is, in accordance with Article 633 of the Turkish Civil Code, its terms are the same for all Customers, without giving preference to one Customer over another.

By concluding this Agreement, the Customer confirms full agreement with its terms, the procedure for booking, payment, cancellation and transfer of the service, as well as safety rules.

The Agreement is considered concluded from the moment of confirmation of the booking (including oral, written or electronic confirmation) and payment of a deposit in the amount indicated on the website or agreed with the Contractor.

1. Definitions of terms

1.1. Public offer — a public offer of the Contractor addressed to an indefinite number of persons to conclude an agreement for the provision of a paid flight with an instructor (paragliding) service.
1.2. Service — a flight with an instructor (paragliding) selected by the Customer on the Contractor's website or ordered through other available communication channels.
1.3. Contractor's website — https://fly-oludeniz.com.
1.4. Customer — a legally capable individual who has reached the age of 18 (or with parental consent — children), or a legal entity that has placed an order for the service and agreed to the terms of the Agreement.
1.5. Contractor — Fly Oludeniz, an organization operating in accordance with Turkish law and providing the flight with an instructor (paragliding) service in Oludeniz, in accordance with international safety and certification standards.

2. Subject of the Agreement

2.1. The Contractor undertakes to provide the Customer with the service of a flight with an instructor (paragliding), and the Customer undertakes to pay for the service under the terms of this Agreement.

3. Booking, payment and prices

3.1. The service is booked through the website, instant messengers, in the office or other communication channels of the Contractor.

3.2. To confirm the booking, the Customer makes a deposit in the amount indicated on the website or agreed with the Contractor.

3.3. The remaining amount is paid on the day of the service in cash at the office before the start of the flight, or in another agreed way.

3.4. Prices for services are set by the Contractor independently and can be changed unilaterally without prior notice to the Customer, depending on the market situation. At the same time, the price of the service fully paid by the Customer before the change is not subject to revision.

4. Cancellation and transfer policy

4.1. In case of cancellation of the booking by the Customer, the deposit paid is not refundable and is considered compensation for the reservation of the Contractor's time and resources.
4.2. If the flight cannot be carried out for reasons beyond the control of the Contractor (unfavorable weather conditions, closure of flight zones, force majeure), the flight is rescheduled to another date by agreement of the parties.
4.3. If the Customer cannot reschedule the flight to another date, the deposit is not refundable.

5. Rights and obligations of the parties

The Contractor is obliged to:
• provide the service on the agreed date and time, subject to safe weather conditions;
• provide a qualified instructor and the necessary equipment;
• inform the Customer of safety rules.

The Customer is obliged to:
• arrive at the specified place and time;
• follow the instructor's instructions;
• report the presence of medical contraindications.

6. Responsibility

6.1. The Contractor shall not be liable for failure to provide the service due to reasons dependent on the Customer (lateness, no-show, refusal of the flight on the spot).
6.2. The Customer shall be liable for compliance with safety rules and instructions of the instructor.

7. Other conditions

7.1. All disputes shall be resolved through negotiations, if impossible - in the judicial authorities of Turkey.
7.2. This Agreement shall be governed by the laws of Turkey.
7.3. The Contractor has the right to make changes to this offer without prior notice, by publishing a new version on the website.
